Sample Contract Language

Contract language for C&D recycling should include at a minimum:

  1. The overall recycling goals for the project

    For example:

    “The [NAME OF INSTITUTION] wants to recycle [GIVE DESIRED RECYCLED AMOUNT OR “as much material as possible”] during [Construction/Renovation/Demolition]. The [Construction/Renovation/Demolition] schedule has been planned to maximize the amount of recycling, reuse, and salvage that can be achieved.”

  2. Minimum diversion rates for the project

    For example:

    “The [NAME OF INSTITUTION] requires that the CONTRACTOR must demonstrate that the [construction/renovation/demolition] project will achieve a minimum of [65]% diversion from landfill.

    The list of these materials is to include, at a minimum:

    1. Cardboard
    2. Clean dimensional wood
    3. Land clearing debris
    4. Concrete
    5. Concrete Masonry Units (CMU’s)
    6. Asphalt
    7. Metals from banding, stud trim, ductwork, piping, rebar, roofing, other trim, steel, iron, galvanized sheet steel, stainless steel, aluminum, copper, zinc, lead, brass, and bronze.]

    The [NAME OF INSTITUTION] believes that, except in unusual circumstances, it is feasible to divert an average of at least [fifty (50)] percent of all C&D debris from construction, demolition, and renovation projects.

    Waste Management Goals: a minimum of [75]% of the total project waste should be diverted from landfill, in order of preference 1) weight, 2) volume, whichever is most feasible to measure.

  3. Requirement of a waste management plan for the project.

    A Draft Waste Management Plan should include, at a minimum:

    1. A list of each material proposed to be salvaged, reused or recycled during the course of the Project (see Estimated Debris Worksheet).
    2. Estimated quantities for each waste stream.
    3. Separation requirements.
    4. On-site storage method for each waste stream.
    5. Transportation method for each waste stream.
    6. Destination of each waste stream.
    7. Estimated tip fee or rebate for each material.

    A Final Waste Management Plan, completed by the Contractor should include, at a minimum:

    1. Analysis of the proposed jobsite waste to be generated, including types and quantities.
    2. A list of all materials from the Project that will be separated for reuse, salvage, or recycling.
    3. Separation and storage requirements for each waste type: A description of the means by which any waste materials above will be protected from contamination, and a description of the means employed in recycling the above materials consistent with requirements for acceptance by designated facilities.
    4. Recycling Vendor: Name of the recycling processor for each material and estimated tip fees or rebate.
    5. Receiving Facilities: The name of the Receiving Facilities intended for receipt of non-recycled CDL materials, the applicable tipping fees, and the projected cost of disposing of all project waste.
    6. Transportation: A description of the means of transportation of the recyclable or waste materials and the approximate cost of transportation. Include the names of haulers.
    7. Meetings: A description of information to be addressed at Project meetings regarding training and updates on waste management requirements.

    Sample Waste Management Plan

    Estimated Debris Worksheet – This worksheet can be used by contractors seeking to bid on the project. It estimates the type and quantity of material that can be salvaged or recycled. It automatically calculates the estimated diversion rate once data are entered.

  4. Documentation for recycling

    For example:

    For each material recycled, reused or salvaged from the Project, the amount (in tons or cubic yards) of material (by type) salvaged or reused, recycled (source-separated), sent to a mixed processing facility, the receiving party, the transportation cost, the amount of any money paid or received for the recycled or salvaged material and the net total cost or savings of salvage or recycling the material. Attach manifests, weight tickets receipts and/or invoices.
    The amount (in tons or cubic yard or material) of material landfilled from the Project, the location of the Receiving Facility, the total amount of tip fees paid at the landfill, and the total disposal cost. Include manifests, weight tickets, receipt, and invoices.

    Diversion Worksheet for Contractors

    Contractors will use this worksheet to report quantities of debris generated, salvaged, recycled or disposed. It automatically calculates the diversion rate once data are entered.
